Supreme Court Ruling on NemID Abuse

Enforcement could proceed against signature holders based on digital promissory notes, even though the signatures were not digitally added by themselves
On January 8, 2019, the Danish Supreme Court issued a ruling in a case concerning the misuse of digital signature NemID. Two individuals had handed over usernames and passwords for their NemID to third parties, who then misused the NemID to digitally sign loan agreements with a bank. The Supreme Court decided that a lower court could enforce the digitally signed debt instruments against the actual owners of the digital signatures, even though they had not themselves signed the debt instruments.
